Terms & Conditions

THIS AGREEMENT IS BETWEEN YORK MOTORHOMES LTD of Damson Cottage, Crooked Lane, Kirk Hammerton, York YO26 8DG and THE HIRER (You)

 

  1. YOUR CONTRACT WITH YORK MOTORHOMES
    By agreeing to  hire the vehicle you are accepting these terms and conditions. Please read this agreement carefully. If there is anything you do not understand or do not agree with, please ask the booking staff at York Motorhomes.

 

2. BOOKING CONFIRMATION AND PAYMENT

a.  An initial payment of £250 is required to confirm the booking, which is non-refundable and enters you into a binding contract for the hire. The balance of your hire money is payable six weeks prior to the start date of your hire, or at the time of booking if you book less than six weeks from the start date of your hire. Any documentation you are requested to provide by York Motorhomes  must be received six weeks prior to the start date of your hire or within two days of booking if less than six weeks from the start date of your hire. Failure to provide full payment and documents as above will result in the booking being cancelled and the loss of your £250 initial payment.

b.  York Motorhomes is happy to accept payment by the following methods:

personal cheque (14 working days required to clear),

debit and credit cards (Most major cards accepted, including Switch, Solo, Maestro, Visa Debit, Visa Electron, Visa Credit and MasterCard).

c.  We can take payment by post or by telephone.

3.  CANCELLATIONS

a.  All cancellations must be notified in writing to York Motorhomes, but please call York Motorhomes immediately to inform them as this will improve the chances of rehiring the motorhome. If notification of your cancellation is received more than six weeks before the start date of your hire you will be refunded in full less the initial payment of £250.

b.  If notification of your cancellation is received less than six weeks before the start date of your hire all monies paid and due are not refundable and you are still liable for any sums not yet paid. However, York Motorhomes will do all it can to rehire the motorhome and if they are able to do so, you will be refunded up to a maximum of your total hire less your initial payment of £250, subject to the amount York Motorhomes is able to rehire the motorhome for.

 

4. HIRE RATES

Hire rates quoted include:

In some cases, York Motorhomes will incur additional charges if the driver to be insured has a traffic conviction, is using a non-UK driving license or is in an occupation which is deemed high risk. These charges will be passed onto you.

York Motorhomes will supply full breakdown cover to cover any mechanical faults to the base chassis of the motorhome. Any call out charges necessitated by you through operator error, e.g. a flat vehicle battery, wrong or insufficient fuel, keys locked in the motorhome etc will be your responsibility.

 

5. SECURITY DEPOSIT

a.  A security deposit of £500 is payable prior to commencement of the hire against any loss or damage to the motorhome (externally or internally), costs or insurance claims as described in these terms and conditions. The deposit will be refunded in full within 10 days of the vehicle being returned, to the agreed location on the agreed date by the agreed time in the same condition as it was let out. Your liability is not limited to £500.

b.  York Motorhomes expects the vehicle to be returned clean.  A charge of £50 will be made if the vehicle requires more than basic cleaning at York Motorhomes discretion.

c.  You must empty the toilet cassette and empty and flush out (with clean water) the wastewater tank at the end of the hire period. There is a £50 charge if you have not emptied the toilet cassettes and £25 if you have not emptied and flushed with clean water the wastewater tanks.  Please note that facilities are NOT available at York Motorhomes premises to empty toilets or tanks.

d.  A refuelling service charge if you have used, and not replaced, more fuel than was supplied originally. The charge is based on the cost of the fuel plus £20.

 

6. DRIVER ELIGIBILITY

a.  No one other than the drivers named in the hire form may drive the vehicle.

b.  Drivers must be over 21 years of age and under 70 during the whole period of the hire, of good health and have held a full driving licence for a minimum of 3 years.

c.  Drivers between the ages of 21 and 22 must hold a clean licence free from any endorsements.

d.  Drivers between the ages of 23 to 24 must hold a clean licence free from any endorsements with the exception of no more than one C rating endorsement in the last 5 years.

e.  The following drivers will NOT be eligible to drive the vehicle

i)   Any driver with any A rating endorsement in the last 5 years

ii)  Any driver who has been disqualified in the past 2 years

iii)  Any driver who has on their licence any of the following offences:

iv)  Any driver who has more than three convictions on their licence

v)  Any driver who has had their insurance declined and/or renewal refused and/or cancelled.

vi) Any driver engaged in or connected with any of the following:

f.  The following drivers should refer to York Motorhomes for eligibility and any additional insurance charges which may apply in the following instances:

i)   Any driver with any A rating endorsement combined with codes CD40 – 70 over 5 years

ii)  Any driver with DD, DR or UT endorsements over 5 years

iii)  Any driver with more than 2 C rating endorsements in the past 3 years.

iv)  Any driver with a B or C rating endorsement incurring a short period of disqualification

v)  Any driver with any B rating endorsement relating to an accident or a fine over £100

g.   Drivers of vehicles weighing over 3,500Kg (i.e. Flash 09 motorhomes) must have the C1 category on their licence entitlements.

h.   All drivers of the vehicle must produce current valid driving licences at the time of vehicle collection to include the photocard and paper counterpart (originals only) of the licence. All drivers must provide an additional form of identification (originals only).

i.   York Motorhomes have the right to refuse to hand over a motorhome to any person who, in the reasonable opinion of York Motorhomes, is not suitable to take charge. In such cases, all hire charges paid will be refunded in full but York Motorhomes do not have any further liability.

 

7. COLLECTION AND DELIVERY TIMES

a.  Unless otherwise agreed with York Motorhomes, the motorhome will be available on the day of collection from York Motorhomes’ depot from 4.00 pm until 6:00pm and must be delivered back to the depot or other pre-agreed location by 10.00 am on the last day of hire.

b.  Late returns can have a significant impact on the next hire. If you fail to return the motorhome on time you may be liable to an extra charge at the discretion of York Motorhomes, but typically £50 per hour plus any additional costs incurred by York Motorhomes as a result. There are no refunds for motorhomes returned early. You will have the vehicle for the rental period shown in the agreement.

 

8. AVAILABILITY
Occasionally motorhomes are not available as agreed, which is almost always due to events beyond the control of York Motorhomes (see below). If your booking has to be cancelled (which York Motorhomes has the right to do), York Motorhomes will offer you the choice of an alternative motorhome or, if no suitable replacement is available, provide a full refund of all monies you have paid for your booking.

 

9. EVENTS BEYOND THE CONTROL OF YORK MOTORHOMES
Unfortunately, events beyond the control of York Motorhomes occasionally affect bookings. When reference is made to such events in these Conditions of Hire, this means any event(s) or circumstance(s), which York Motorhomes could not, even with all due care, foresee or avoid.

York Motorhomes cannot accept responsibility or pay any compensation, costs or expenses where the performance of your contract with York Motorhomes is prevented or affected or you otherwise suffer any loss or damage as a result of events beyond York Motorhomes's control. This includes any delays to and/or restrictions to your hire to which you may be subject. However, if your booking has to be cancelled as a result, York Motorhomes, will of course offer you the choice of an alternative motorhome (if available) or refund as described above.

 

10.  PETS
The acceptance of pets in the motorhome will be by agreement with York Motorhomes. York Motorhomes welcomes pets in some of our motorhomes, so please check before booking.

 

11. SMOKING
York Motorhomes operates a strictly enforced no smoking or naked flame policy in all vehicles. If evidence of smoking in the vehicle is identified, you will be charged the full cost of cleaning all soft furnishings, and any resulting loss of business if this cannot be carried out prior to the next hire.  You will also be fully liable for any damage or injury caused by smoking or naked flames in the vehicle.

 

12. BED LINEN AND TOWELS
Bed linen, pillows and towels are provided, free of charge, if requested at the time of booking.  York Motorhomes will launder bed linen and towels using domestic automatic washing facilities free of charge.  Any bed linen or towels returned in a state such that the above level of laundering is insufficient will have the cost of replacing the items deducted from their security deposit.

 

13. TRAILERS

a.   Some of our Motorhomes are fitted with tow bars (i.e. Flash 09).  You may tow a trailer under the following conditions.

b.   The trailer itself and contents are NOT covered by our insurance at any time.  York Motorhomes accepts no liability for any damage to your trailer or it’s contents however caused.

c.  When being towed by our vehicles, third party liabilities will automatically be extended to cover a trailer.

14. YOUR RESPONSIBILITIES

a.  You must look after the vehicle and the keys to the vehicle. You must always lock the vehicle when you are not using it, and use any security device fitted to or supplied with the vehicle.

b.  You must always protect the vehicle against bad weather which can cause damage.

c.  You must make sure that you use the correct fuel.

d.  You are responsible for any damage to the vehicle caused by hitting low level objects, such as bridges or low branches.

e.  You must not sell, rent or dispose of the vehicle or any of its parts. You must not give anyone any legal rights over the vehicle.

f.  You must not let anyone work on the vehicle without York Motorhomes’ permission. If York Motorhomes does give you permission, you will only receive a refund if you have a receipt for the work.

g.  You must let York Motorhomes know as soon as you become aware of a fault in the vehicle.

h.  You must bring the vehicle back to the place agreed, at the time agreed and remain responsible for the vehicle until this time. York Motorhomes must see the vehicle to check that it is in good condition.

i.  If the vehicle is returned damaged, inside or out in any way, you will be liable for the full cost of repairing any damage not covered by our insurance. Where the damage is covered by our insurance, you will be liable for the first £500 to cover the insurance excess.  If the damage to the vehicle results in loss of business, you will be liable for all losses, costs and damages incurred by York Motorhomes.  This may include but is not limited to deduction of such damages from the security deposit.

j.  Before you bring back the vehicle you must check that you have not left any personal belongings in the vehicle.

 

15. CONDITIONS FOR USING THE VEHICLE

a.  You will ensure that the maximum number of persons carried in the vehicle does not exceed the number of sleeping berths.

b.  You will also ensure that the driver and all passengers will wear seat belts whenever the vehicle is being driven where required to by law.

c.  You or any other authorised driver must not:
• Use the vehicle for hire or reward;
• Use the vehicle for any illegal purpose;
• Use the vehicle for racing, pacemaking, testing the vehicle’s reliability and speed or teaching someone to drive;
• Use the vehicle while under the influence of alcohol or drugs;
• Drive the vehicle outside England, Scotland and Wales, unless we have given you written permission;
• Overload the vehicle.

 

16. CHARGES
Charges are based on York Motorhomes price list at the time of booking. You will be charged for:

a.  The rental and any other charges we work out according to this agreement.

b.  A charge for any loss or damage to the motorhome including that caused by neglect, misuse or accident whether or not it is your fault, subject to the cover provided by the hire insurance.

c.  Any charge for loss or damage resulting from you not keeping to condition 14.

d.  Gas is included, but should you need to replace an empty bottle during the course of your hire, this is your responsibility.  The vehicle must be returned with the same number of bottles of the same type and size.

e.  All fines and costs (including court costs) for parking, traffic or other offences, congestion charges, (including any costs which arise if the vehicle is clamped). You must pay the appropriate authority any fines and costs if and when the authority demands this payment. If you do not, you will be responsible to pay any costs and reasonable administration charges which arise when York Motorhomes deal with these matters.

f.  Any charges arising from Customs and Excise or Immigration Authorities seizing the vehicle, together with a loss-of-income charge while the York Motorhomes cannot rent out the vehicle, if and when York Motorhomes demand this payment.

g.  Any published or agreed rates for delivering and collecting the vehicle

h.  nterest which will be added every day to any amount you do not pay on time, at the rate of 4% a year above the base lending rate of Barclays Bank from time to time.

i.  Value added tax and all other taxes on any of the charges listed above, as appropriate.
You are responsible for all charges, even if you have asked someone else to be responsible for them.

 

17. THE HIRE INSURANCE

a.  The motorhome is insured for the period of the hire and a copy of the insurance policy is available from York Motorhomes on request. By signing the attached form you are accepting the conditions of the hire insurance policy.

b.  You are liable for any damage to the vehicle which is not covered by an insurance claim.  The security deposit will used to cover the insurance excess for the first claim. This excess applies to each and every incident and it includes any loss or damage to equipment, fixtures including damage to tyres, wheels and wheel trims, loss of roof lights, loss of windows or damage to third party vehicles or property.

c.  York Motorhomes will not be liable for claims in respect of any loss or damage to your personal belongings or your effects or those any other person or persons.

d.  Damage of any kind to the vehicle, or it’s equipment, must be reported to York Motorhomes immediately so we can get replacements.  If you fail to do this and subsequent hires are affected you will be liable for all losses, costs and damages incurred by York Motorhomes.

NOTE: You are advised to take out additional holiday insurance to cover your own belongings, un-avoidable cancellation and personal accident and injury.

 

18. WHAT TO DO IF YOU BREAK DOWN
No responsibility can be accepted by York Motorhomes for any loss or damage or expense which occurs as a result of any defect or breakdown.
If you do breakdown you should:
• Contact the breakdown service that covers the vehicle
• Inform York Motorhomes immediately

You may give instructions for repair or replacement up to £75 for which you will be reimbursed on production a receipted invoice when the vehicle is returned for all mechanical faults. Repairs or replacements in excess of £75 must have approval of York Motorhomes.  As detailed in condition 4, you will bear the cost of callout, repair and replacement where necessitated by operator error.

 

19. WHAT TO DO IF YOU HAVE AN ACCIDENT
No responsibility can be accepted by York Motorhomes for any loss or damage or expense which occurs as a result of any accident.
If you have an accident you must not admit responsibility. You should get the names and addresses of everyone involved, including witnesses. You should also:
• Make the vehicle secure
• Tell the police straight away if anyone is injured or there is a disagreement over who is responsible; and
• Contact York Motorhomes immediately.
You must produce an accident report sending it to York Motorhomes.

 

20. WINDSCREENS AND TYRES
You are responsible for any damage to windscreens and windows, punctures or other damage to tyres during the period of the hire. Where possible it should be repaired or replaced as appropriate and paid for by you at the time. You should contact York Motorhomes to seek instructions before carrying out the repair. Failing this, you will be charged the full cost of repair.  A charge will also be made against your deposit to cover any resultant loss of income.  

 

21. INFORMATION
If you break the agreement we can give the information you have provided to credit reference agencies, the Driver and Vehicle Licensing Authority (DVLA), debt collectors and any other relevant organisation. We can also give this information to the British Vehicle Rental and Leasing Association (BVRLA), who can pass it on to any of its members for any purpose stated in the Data Protection Act 1998.

 

22. PARKING

You are welcome to leave your car at York Motorhomes premises during the hire period at your own risk.

 

23. SHOPPING

Should you wish to take advantage of this service, York Motorhomes cannot take responsibility for:

 

24. ENDING THE AGREEMENT

a.  If you are a consumer we will end this agreement straight away if we find out that your belongings have been taken away from you to pay off your debts, or a receiving order has been made against you. We will also end this agreement if you do not meet any of the conditions of this agreement.

b.  f you are a company, we will end this agreement straight away if:
• You go into liquidation;
• You call a meeting of creditors;
• We find out that your goods have been taken away from you until you pay off your debts;
• You do not meet any of the conditions of this agreement

c.  If we end the agreement if will not affect our right to receive any money we are owed under the conditions of this agreement. We can also claim extra costs from you if you do not meet any of the conditions of this agreement. We can repossess the vehicle and charge you if we do this.

 

25. GOVERNING LAW
This agreement is governed by English law under which any dispute will be settled.
